| dc.description.abstract | This research specifically examines the ta'ammulat (analytical observations) of Imam Al-Haskafi in "Al-Durr Al-Mukhtar" with special reference to financial transactions and their contemporary interpretations.Ta'ammul (analytical observation) is a significant terminological concept employed by Islamic jurists that holds particular importance in the codification of Islamic law. The study is premised on the hypothesis that Al-Haskafi's analytical observations not only provided solutions to the financial issues of his time but continue to offer valuable guidance for contemporary financial and economic challenges. The primary focus is to investigate the nature, rationale, and modern applicability of his analytical observations in financial matters. The research addresses three fundamental questions: What are the underlying reasons for Al-Haskafi's use of the term ta'ammul in "Al-Durr Al-Mukhtar"? How did Imam Ibn Abidin Al-Shami and Imam Al-Tahtawi explain these analytical observations in the context of financial transactions? What are the potential interpretations of these observations in modern financial and economic systems? The methodology employs both Thematic Research Method and Grounded Theory approaches. The study involves a comprehensive analysis of "Al-Durr Al-Mukhtar," supplemented by detailed examinations of its two major commentaries: "Radd Al-Muhtar" by Ibn Abidin and "Hashiyat Al-Tahtawi." Modern research tools, including Maktaba Shamela, the Islamic Jurisprudence Encyclopedia, and other digital resources, have been utilized for comprehensive data collection and analysis. The research concludes that Al-Haskafi's analytical observations not only reflect the depth of juristic discourse but also offer significant potential for addressing contemporary financial and economic challenges. Particularly in matters of murabaha (cost-plus financing), ijara (leasing), rahn (mortgage), and waqf (endowment), these observations provide valuable frameworks for developing solutions to modern financial issues, demonstrating the enduring relevance of classical Islamic juristic thought in contemporary financial contexts. | en_US |
