Abstract:
Though Pakistan is signatory to many international instruments that are laid down to protect the rights of labors and in spite having a legal framework in the country which aims to protect workers, unfair labor practices remain a significant issue in Pakistan. This research work argues that weak enforcement mechanism, lack of checks and balances, limited worker awareness, and inadequate penalties are the key factors behind this persisted problem. The analysis highlights several shortcomings in the current system. Firstly, poor implementation of existing labor laws creates loopholes for exploitation. Secondly, the absence of robust checks and balances allows violation to go unchecked. Furthermore, a lack of awareness among workers regarding their rights weakens their bargaining power and makes them vulnerable to abuse. Finally, insufficient strict punishments fail to deter employers from engaging in unfair practice. To address these issues, this research work proposes a multi-pronged approach. Strengthening law enforcement mechanisms is crucial to ensure effective implementation of labor regulations. Establishing severe consequences, including hefty fines and potential business closure for repeat offenders, will act as a stronger deterrent. Additionally, rising public awareness through educational campaigns can empower workers to understand and claim their rights. Finally, Aligning Pakistan's labor law with international convention can foster best practices and hold the country accountable to global standards. By implementing these measures Pakistan can take concrete steps towards creating a fairer and just labor environment for its workforce.
