dc.description.abstract This study encompasses the history of communal violence in India specifically between Hindu’s and Muslims. The history of such violence is old and can be seen in the pre partition era. It has a great influence on the people of the country specifically the minority. Despite the fact that these violence’s have killed millions of people till date but no proper constitution has been made to either stop such conflicts or to provide proper rights to the minority, that is, Muslims.India being a secular country has failed to protect the minorities particularly by passing such laws that directly point and hurt the feelings and put religious freedom of Indian Muslims at stake and promote marginalization of Indian Muslims. This study covers all the factors that played their roles in the increased brutality against Indian Muslims and how the Indian government has always overlooked the inhuman practices. Moreover, the impact of such factors has affected the country's law and order conditions. However, the Indian government has always shown biased response on such incidents and never played its role responsibly.Furthermore this research also discusses the international law and little attention has been given to how these practices and policies violate international human rights law, including India's obligations under treaties such as the International Covenant on Civil and Political Rights (ICCPR)). These violations, particularly concerning religious discrimination, further intensify the disenfranchisement of Indian Muslims, but remain inadequately addressed in current scholarship. en_US
