An analysis of juvenile prisoners legislation in Pakistan under international law

Abstract

"Pakistan evolved its Prisons Rules and regulations from the Britishers after partition of Sub continent. Over time, the deteriorating conditions within prisons and the plight of inmates garnered the attention of both governments and human rights organizations. In Pakistan Juvenile prisoners constitute a total of 19 percent of total prisoners and unfortunately no specific provisions for the rehabilitation and Character building lectures within jail premises. Prisons evolved into breeding grounds for criminal activity and hubs of unlawful conduct. It is imperative that policies centered around prisoner classification be developed to enhance the living conditions of convicts. The prison system is intricately interconnected with other components of the criminal justice system, including the police, courts, and community corrections. Therefore, any reforms aimed at improving prisons must involve all relevant stakeholders. This study examines the dire conditions prevailing in Pakistani jails and the situation of prisoners in light of the recommendations made by various commissions and committees tasked with reforming the prison system. It also covers Juvenile Prisoners Act 2018 and its pros and cons in detail. These conditions must be ameliorated in accordance with the proposals set forth by these commissions and in compliance with the International Conventions and Regulations on the Human Rights of Prisoners as defined by the United Nations."
