dc.description.abstract This research thesis analyzes the procedure of adoption given by Islam and how it is practiced in Pakistani institutions. According to this study, complete restriction does not imply that adoption is not done. Adoption does occur in Pakistan; however it is outside the purview of the law, particularly Islamic law as it is outlined in the Quran and Sunnah. Adoption must be regulated in Pakistan for it to fall under Islamic law. Adoption has a complicated and ambiguous place in the social vision of many societies throughout history. The notion of adoption and its legal, moral, and ethical ramifications were also examined in this thesis. Additionally, it suggested the changes to Pakistani legislation to allow for the application of Islamic Shariah Law. The major goal of this thesis is to highlight the significance of adoption in Islamic and Pakistani law, moreover it further professes to rectify any shortcomings. The research demonstrates how, under some circumstances, Islamic jurisprudence offers sufficient grounds for permitting inter-state adoptions. There is no doubt that it is a religious duty to care for infants and orphans. Finding the child loving families may be one of the best ways to care for them if the gender of the child is not consciously concealed or denied. A state sponsored system of Kafala should be introduced where the child can be adopted with the agreement of biological parents but will not take the family name or inherit as it is the condition in Islamic law. en_US
