Abstract:
Resolving IP disputes through litigation is an unsatisfactory battle which has increased the usage of Alternative Dispute Resolution Mechanism; though it has its pros and cons for settlement of IP matters but it is gaining legal stand-off for swift and better disposal of issues. This research aims to compare litigation and ADR mechanism as the means to resolve IP Disputes. It will explain how the modern world today needs ADR Mechanism for resolving new types of IP disputes. But it will also inspect on preference of parties to choose method for settling their dispute. Research will bring life to mechanism in Pakistan whereby ADR can’t be used to sort out the matters and litigation is still a preferable way. This study will explore through real disputes, judgments, and arbitral awards to reach its answers.
