dc.description.abstract | No business in the world can operate in isolation, with rapid globalization States and business go beyond the borders of their country of origin. These business enterprises end up in conflict zone or at times complicit to the parties of conflict. The passive and assertive approaches of multinational corporations and defining the concept of non-state actors actively participating in Armed conflicts, the IHL covers the non-state actors in its Additional Protocol I Article 47.2 while defining Mercenaries as non-state actors. The similarity between the non-state actors is the sole purpose of profiteering and neglecting the human rights abuse. However, the international law in unable to map the obligation of these corporation for defilement of international humanitarian Laws, neither the criminal nor civil corporate liability able to address these concerns under the International legal framework, thus leaving this unaddressed. The objective of the study is bringing in the cases from various conflict zones where these international corporations have played a negative role. The objective of the study is to make the world realize this evident fact still and identify the ways to fix the liability on legal person. The study suggests the ways and means to contain the damage through monitoring the operations and licensing of these Multinational organizations while at the same time their positive role is highlighted for their business growth globally. | en_US |
